Who Qualifies?

Enacted in 2009, Maine state law legalizes marijuana use for Maine residents who are properly certified by a physician.

In order to be certified, a prospective patient must meet these qualifications:

  • Be a Maine resident

  • Possess a Maine driver's license or state photo identification card

  • Have one of the qualifying medical conditions or symptoms from the list below

As of October 2013, any of the following medical conditions or symptoms are accepted by the state:

  • Pain (though patients must demonstrate that the pain is chronic and has not responded to ordinary medical or surgical measures for more than 6 months)

  • Severe nausea

  • Seizures

  • Severe muscle spasms

  • Wasting syndromes (severe weight loss, also known as cachexia)

  • Cancer

  • Inflammatory bowel disease (such as Crohn's or ulcerative colitis)

  • Glaucoma

  • HIV or AIDS

  • Hepatitis C

  • ALS (Lou Gehrig's disease)

  • Alzheimer's disease

  • Nail patella syndrome (a rare birth defect)

  • Post-traumatic stress disorder (PTSD)

For minors (patients under 18 years):

  • MMJ Physician Services currently does not certify minors, though they are willing to consider cases on an exceptional basis (e.g., end-stage cancer). In addition to all the requirements above, the state has very strict requirements for minor certification, including independent evaluation by two physicians and a notarized affidavit signed by both parents.

For patients with any type of mental illness (depression, anxiety, insomnia, PTSD):

  • Except for PTSD, Maine law currently does not consider any mental conditions sufficient for qualification.

Details on
   'Qualifying Pain'

Many Maine patients qualify by having pain that is insufficiently relieved by other medical treatments for over six months. The types of disorders qualifying under the pain category include such things as arthritis, headaches, prior trauma, fibromyalgia, and the like. For such patients to be certified, this history of pain must be verifiable through prior medical records. 

Confidentiality

Prospective patients may be reassured that MMJPS services are absolutely confidential. Patient information, medical history, clinic visits, and any communications are kept private. Maine privacy laws regarding medical marijuana certification and use are both patient-oriented and progressive. Accordingly, patient records are never released to the state or medical facilities outside the clinic (unless the patient specifically tells us to do so).
